Swerve Industries LLC (doing business as “Swerve Repair”) (“Swerve Repair,” “we,” “us,” or “our”) values your privacy. This Privacy Policy describes how we collect, use, disclose, and retain personal data when you use our mobile application (the “App”) and website (collectively, the “Services”).
This Privacy Policy is intended to comply with applicable privacy laws, including the Colorado Privacy Act (“CPA”).

1.1 Personal Data You Provide Directly
We collect the following categories of personal data when you use the Services:
Account Identifiers: Name, email address, phone number, and login credentials, used to create and manage your account and authenticate access.

1.2 Personal Data Collected Automatically
When you access or use the Services, we collect:
Usage Data: Pages viewed, features used, access times, referring URLs, and IP address, used to monitor performance, detect fraud or abuse, and improve functionality.
Device Data: Device type, operating system, unique device identifiers, and network information, used for troubleshooting, security, and optimization.
Geolocation Data (Sensitive Data):
We collect precise geolocation data only if you affirmatively opt in through your device or application settings.
We do not collect precise geolocation data by default.
Geolocation data is used solely to match users with nearby repair providers, estimate service availability, and improve location-based functionality.
You may revoke consent at any time through your device settings or within the App, and we will cease further collection.
1.3 Personal Data from Third Parties
If you choose to connect third-party services (such as social media accounts), we may receive identifiers and profile information from those services to facilitate account creation or login.
2. Purposes for Processing Personal Data
We process personal data for the following specific purposes:
To create, manage, and secure user accounts;
To identify vehicles and generate repair histories based on VIN and vehicle data;
To connect users with repair vendors and facilitate repair services;
To process payments, refunds, and transaction records;
To communicate repair status updates, service notifications, and account-related messages;
To provide customer support and respond to inquiries;
To improve and optimize the Services through analytics and usage analysis;
To detect fraud, misuse, or security incidents;
To comply with legal obligations and enforce our agreements.
We do not process personal data for purposes incompatible with those listed above without obtaining additional consent where required by law.

We disclose personal data only as necessary for the purposes described above, including:

We do not sell personal data as defined by the Colorado Privacy Act.
4. Targeted Advertising and Opt-Out Rights
We may use limited usage or device data to deliver advertising or promotional content.
Colorado residents have the right to opt out of:

Universal Opt-Out Mechanisms

5. Data Retention
We retain personal data based on the following criteria:
Account Data: Retained while the account remains active and for up to five (5) years after account closure, unless a longer retention period is required by law.
Vehicle and Repair Records: Retained for seven (7) years to comply with legal, warranty, and dispute-resolution obligations.
Payment Records: Retained as required under financial and tax laws.
Usage and Device Data: Retained for up to 24 months for analytics and security purposes.
We delete or de-identify personal data when it is no longer required for the purposes above.
6. Your Colorado Privacy Rights
Colorado residents have the right to:
Confirm whether we process their personal data and access that data;
Correct inaccuracies in their personal data;
Delete personal data;
Obtain a portable copy of their personal data;
Opt out of targeted advertising, sale of personal data, or qualifying profiling.

We will respond to verified requests within 45 days, with one permitted 45-day extension if reasonably necessary, with notice.
Appeals Process
If we deny your request, you may appeal by emailing support@swerve.repair with “Privacy Appeal” in the subject line.
We will respond to appeals within 45 days.

7. Children’s Privacy
The Services are not directed to children under 13, and we do not knowingly collect personal data from children.
8. Security
